Nunes Marques suspends decision of the TRE who dismissed Mayor of Barueri

The Minister of the Superior Electoral Court (TSE) Nunes Marques suspended this Thursday (1st) decision of the Regional Electoral Court (TRE) of São Paulo that determined the immediate revocation of the mandates of the mayor of Barueri (SP), Beto Piteri (Republicans), and the deputy mayor, Dr. Claudia (PSB), for misuse of the media.

“In the case file, it is found that the act of co-worker-judgment rendered by TRE/SP-appears to be in dissonance of precedents of this Court according to which the decisions of the regional courts that imply the revocation of a candidate elected in the municipal elections must be fulfilled after the exhaustion of the ordinary instances, except for the precautionary provision before the extraordinary instance,” the minister in the decision.

Nunes Marques also pointed out that the TSE is the final judgment instance for application registration rejections.

“I recall the understanding that the TSE is the final instance to execute a decision to reject registration,” said the minister.

The case should still be analyzed by the TSE plenary.

Defense

The mayor's lawyer, Rafael Carneiro, said in a statement that Minister Nunes Marques recognized the prematurity of the cassation, since the case will still undergo analysis of the Superior Electoral Court.

“Thus, the maintenance of managers in office was guaranteed, preserving the administrative normality in the municipality and the result of popular sovereignty,” said the defense.
